I am pleased to inform you that we were able to work out a settlement with Elizabeth Deuble and Mercury Medical, Inc. through mediation which finally was approved by all parties today.  I am sure you are glad to know that you will not have to be bothered with appearing at trial on January 29.  We do, however, greatly appreciate your assistance to us.  I think the information that you could provide went a long way toward convincing that both the Plaintiff and Mercury Medical to take a more reasonable approach to this case.  I am sure Drager Medical, Inc. is also very grateful to you for the advice you have given them regarding these casters.

Dear Dr. Barkalow:

We are pleased to advise you that a settlement has been reached in the case of Scharla Weber v.
Hays Medical Center.  The settlement will allow Scharla to be moved from the nursing home
where she has resided for the past couple of years to an in-home setting where she can be cared
for by her parents with the assistance of high level nursing care.

It is only through your efforts and your honesty with respect to the negligence that occurred in
this case that allowed us to reach a settlement with the hospital.  On behalf of the Weber family, I
would like to thank you for your assistance in this matter.  I do look forward to working with you
again, in the future, on another case.

Please submit to me as soon as possible your final billing in this matter.  A hearing to approve
the settlement will be held on Monday, November 6, and I must have all the expenses collected
by that date.
